The service manager is only supposed to discuss vehicle inspection findings with the customer. He is not a vehicle appraiser and hence he should not have deterred the client from buying the vehicle due to branded title .

We apologize for your dissatisfaction of your purchase of a 2008 BMW X5. The vehicle in question did have the necessary inspection for safety, issues for a vehicle of this age. It was priced accordingly and sold as is. We did what we can to assist in repairs. We also apologize for the states error in title which is expected to arrive any day. We will contact you as soon as we receive the title.

1. First of all Illinois law prohibits "Sold-as-is". Please read https://www.news-gazette.com/news/local/john-roska-new-state-law-prohibits-as-is-sales-of/article_e2334b1f-8cc8-5de2-80a7-5c0a5bfcf9ac.html 2. The implied warranty says all internal parts. 3. The vehicle inspection report on the day vehicle was bought was not provided. Please send it to me since you are claiming that you had done inspection.If you had done inspection thoroughly then how customer brought vehicle back to you in two hours and how did it stop working completely at JC's auto care which was confirmed by your general manager of Sales ( Mr. Joe Shoemaker). Please do some facts check. 4. The vehicle inspection report on the day broken BMW X5 was patched and returned was also not provided. Please send that too. I will give you BMW Barrington and BMW Schaumburg service center's detailed report. JC's auto care only recommended me to get report from them as they also acknowledged that this vehicle is not safe. 5. When customer gets vehicle back after repair, it is your responsibility to do safety check and send it back to authorized BMW repair center. Instead you sent me to JC's in that risky vehicle even though I had fracture. 6. Mr. Joe Shoemaker acknowledged that the Vehicle is broken and cannot get started. It was sent to non BMW authorized repair shop and JC's acknowledged that they have limited resources so I have no complain for JC's. They were not hiding anything. Since vehicle was broken at JC's it is between JC's auto care and Schaumburg Toyota to deal with the refund to customer rather than customer get patched vehicle which is very unsafe. 7. When vehicle was broken, another used vehicle could have been given to me or I could have bought Brand new vehicle without asking refund and adjusted the difference in the cost of the different vehicle. One manager agreed, another was on different page. One general manager agreed, another had different opinion. How customer should deal with your internal differences? 8. Mr. James told me that title takes 6 months too. The law is 20 days. I am forced to trade-in my BMW to other dealership as I cannot drive that at all so if the deal breaks due to your error with title then you have to pay full refund otherwise the difference in the loss + compensation for harrassment. 9. Please send your buyer's guide too. I will send it to FTC. The FTC rule has been posted on https://www.consumer.ftc.gov/blog/2018/07/ftc-looks-revised-used-car-buyers-guides
