Let me start off by saying I used to sell vehicles and know from working with certain people it is difficult to find an honest, caring and friendly sales consultant. Those words and many more would be us know from working with certain people it is difficult to find an honest, caring and friendly sales consultant. Those words and many more would be used to describe our sales man Robert Mitchell and finance manager Arnie Phelps. My girlfriend was in immediate need of a new vehicle and for the most part knew exactly what she was looking for. Robert helped us make sure of the exact model she wanted. Robert made the transaction very easy especially the negotiations. We then met with Arnie Phelps to get approved and it was quick and seamless, as well he reminded me the importance for a maintenance contract as well as service contract. They both were completely honest with the pricing and costs of the items and provided document proof. All the sales manager were very friendly and made us feel very welcome. We picked up the vehicle and Robert showed my girlfriend and I every thing about the car that needs to be shown. This vehicle purchase was not stressful and all in all a great experience, we completely recommend Smithtown Nissan and more importantly Robert Mitchell and Arnie Phelps. I own Nissan's staple car an 2011 Nissan GTR, and I brought my car there for service, because my car basically shut down, couldn't start, failed on me in the middle of Northern Boulevard. I had to get brought my car there for service, because my car basically shut down, couldn't start, failed on me in the middle of Northern Boulevard. I had to get it towed back to my house, and then the reason I brought it to Nissan of Smithtown was because multiple friends of mine recommended them to me as they fixed their car with no hassle. As I spent approximately $700 in tow fees to get it towed there. I was greeted by George the service adviser, he was very friendly and took care of my car very well keeping it inside as it was being repaired. I have no doubt in my mind they have nice employee staff, but I am not happy how they dealt with my situation. I am an car enthusiast myself and I have aftermarket parts installed on my car (i.e: exhaust, midpipe, downpipes, injectors), all mostly piping. So its clearly explained to them I have no reason why this problem happened to me, as I was looking up information before I dropped it off, as I am a member of North American GTR Owners Club (NAGTROC) which a community for all GTR owners to share their knowledge and experience about the car. Looking up the information I found led me to finding the failure of an electrical part, which can happen to any car. I also found a similar customer with a similar story having the same exact problem and their car was completely stock. So as I explained to George the service adviser he notes down the part that failed, and reports it to the GTR tech. They diagnose the problem and want to swap it out for a new one, but they won't cover it under warranty. So I ask why, they explain "because my car is too modified". That clearly does not explain the reason why it caused the problem to fail. As I am going back and forth with the adviser and going no where, it goes to the service manager Joe Valero, and he basically said the same thing. So I decide to bring this to Nissan North America, basically I explained them the situation , creating a case they basically said to me that its the dealer decision to fix and warranty a part. So basically I am stuck on this boat going no where while my car is sitting there, yet I have no loaner car whatsoever. According to the Magnuson and Moss act by the federal trade commission: it states that No. An 'aftermarket' part is a part made by a company other than the vehicle manufacturer or the original equipment manufacturer. A 'recycled' part is a part that was made for and installed in a new vehicle by the manufacturer or the original equipment manufacturer, and later removed from the vehicle and made available for resale or reuse. Simply using an aftermarket or recycled part does not void your warranty. The Magnuson-Moss Warranty Act makes it illegal for companies to void your warranty or deny coverage under the warranty simply because you used an aftermarket or recycled part. Still, if it turns out that the aftermarket or recycled part was itself defective or wasn't installed correctly, and it causes damage to another part that is covered under the warranty, the manufacturer or dealer has the right to deny coverage for that part and charge you for any repairs. The FTC says the manufacturer or dealer must show that the aftermarket or recycled part caused the need for repairs before denying warranty coverage. if you want to look up the ACT, google FTC, magnuson & moss act. Yet they still denied my warranty claim, but they wanted me to "return my car to stock state", basically take all the modifications off my car, which means almost 10's of thousands of dollars wasted, and countless man hours as well. Finally I decide it needs to get fixed and said to my self I want my car back, so go ahead and fix it, but the part doesn't fix it I am not paying for the part and they agreed, I would only pay for labor, but they would work on the price with me on that. After they swap out the part, its not fix. They diagnose the problem again and they said another part needs to be fixed and it will most likely be fixed. So the part was replaced it didn't fix the problem, now another part is being ordered and being replaced. Currently my bill adds up to be around $1400...who knows where it be will if these two parts aren't the only parts that need to be replaced. In the end, I wouldn't recommended my friends and family to this dealer for service, as I was not happy, with the overall outcome of how they went about my warrantying the parts on my car, as it clearly isn't anything that had to do with my modifications on my car, as it also happened to someone else with nothing done to their car. My car has been there for almost a month now...and it still not done and I don't know what to do anymore...seems like the dealership is playing games with me, as if they don't know whats going on with the car... car took about a month to fix...paid about $1800 in dealership fees, when it could have all been warrantied... Never doing business with them again, avoid service department More
