The facts as we know them to be are as follows. Brandon Tuck found a 2005 Acura TL on our web site at some point prior to Saturday Jan 3, 2015, and contacted our salesman, Arsenio Eatmon, to arrange an appointment to test drive and possibly purchase the Acura. Mr. Tuck and a woman whom we believe introduced herself as his mother, arrived on Jan 3 at around 4:15-4:20 p.m. They inspected the vehicle and proceeded to take it for a test drive that lasted approximately 15 minutes. In total Mr. Tuck and the lady accompanying him spent about 30 minutes with the vehicle before entering the premises to complete the sale. Mr. Tuck, his guest, and Arsenio discussed the price of the vehicle and settled upon the asking price of $9,991 plus a $269.50 documentation fee, totaling $10,260.50. Arsenio handled the negotiations alone, and to our knowledge neither Mr. Tuck nor his guest asked to speak to the sales manager, Michael Mathews. Once the total price was agreed upon, the Finance manger, Jason Bell prepared the paperwork and had Mr. Tuck sign the documents. As paperwork was being signed Mr. Tuck discovered that AL tax had been accidentally included on two of the documents. Since the vehicle was to be registered in FL, no tax was collected, and this oversight was corrected by reprinting two documents. During this time Arsenio hand washed the vehicle and looked it over for flaws. Mr. Tuck and his guest departed the dealership at approximately 5:20, the same time a tornado and flash flood warning was issued for the area. They indicated they would be driving east toward the Anniston area, approximately 125 miles in the same direction the storm was travelling. On Monday Jan 5, 2015, our General Manager Kevin Garner received a call from Brandon Tuck, and they discussed the fact that at some point on the drive home a body trim part had become detached from the lower rear passenger side of the Acura. Mr. Garner explained to Mr. Tuck that we would be willing to help him with some aspects of having the problem corrected, but our offer would not include purchasing the missing part. Mr. Garner explained that since the part was present when the vehicle left our premises that we could not be held responsible for a vehicle sold AS IS, that had travelled in excess of 100 miles in the worst weather event in recent history. Mr. Garner did offer to secure the part for Mr. Tuck at wholesale price and to install the part free of charge at a mutually agreeable location. However, Mr. Tuck was able to find the part at a lower cost than we were. They also discussed the fact that Mr. Tuck was moving to FL in just one or two days and the part may not arrive prior to his departure. Mr. Garner offered to pick up the part and pay the shipping charge to get the part to FL. At this point both parties seemed amenable to the outcome of the discussion and concluded the conversation. The following day we became aware that persons whom were not involved in the transaction, and who had never spoken to us about the situation, had gone to social media sites and begun posting negative comments about our dealership and their anger at the deal we made with Brandon Tuck. Posts from Chuck Tuck, whom we believe to be Brandon’s father, and Melanie Tuck, who states she is Brandon’s wife, as well as negative posts from some random friend, have appeared on Face Book and other public sites. To our knowledge none of these people have made any effort to contact us, or attempt to reach any other resolution outside of what Mr. Garner and Brandon Tuck agreed to. We have made recent attempts to contact Brandon but have been unable to reach him. Additionally, we would welcome a chance to correspond with any of the interested third parties, but since these persons seem unwilling to reach out to us, preferring instead to attack us surreptitiously through social media, we will continue to defend our position and our reputation against their scurrilous attacks
