Dear Mr. Graham, I have spoken to the General Manager for Tri County Lexus, and as he explains there was never a question of you receiving your deposit refund. None of our companies have a policy to permanently keep a customer's good faith deposit. These monies are only to ensure that when we purchase a car specifically for a customer at their behest, at the contracted and agreed price, that we have monies in the house to secure the purchase of a vehicle that is not in our inventory. It is very rare that a customer will not choose to take delivery of a vehicle we have purchased specifically for them. Our corporate policy states, that in the event this does occur, we will refund the deposit only once we have resold the vehicle for the same or more of the original signed contract. This is a standard policy in the industry, and condoned by the office of the attorney general in all of the states that we do business. I’m sure you can see how a major investment such as the vehicle you purchased must be protected against over stocking. Our inventories are closely scrutinized, and must be balanced to provide the greatest mixture of product for our customers. Having said that, I understand there was a great deal of miscommunication during the negotiation process regarding our documentation fees, and from your posting on DealerRater I can see that we have provided a much lower standard of service in your case than we strive for. I would be willing to work outside of our policy in your case and forgo the usual waiting period provided I was assured that you were completely satisfied with the outcome, and felt there was no further need to pursue any negative reporting to any third party agents. I am truly sorry for the lost opportunity to earn your business. I would have liked to have spoken to you personally when you were here, and avoided any feelings of ill will. I am determined to rectify this situation so that you can feel that although we were unable to come to an agreement, you were at least satisfied with the outcome. After we have completed this perhaps you would allow me as a small gesture to help you with the cost of your next chargeable service on your new vehicle. Synthetic oil replacement, although much more efficient, can be expensive. Thank you for your response. I look forward to meeting you in person. Sincerely, Paul Stumpf

I was told verbally by Justin that the deposit was fully refundable. I also signed a deposit authorization which said that the deposit was refundable if Tri-County was not willing to sell the vehicle at the price that Camillo and I had agreed upon. The sales contract that Tri-County provided after I signed the deposit authorization contained expenses and fees that I had not agreed to and therefore I told Rudy that I did not wish to do business with Tri-County and fully expected my deposit to be refunded consistent with the deposit authorization that I had signed. On Friday I contacted Lexus customer support. Tammy Hawkins from Lexus got Camillo on the phone and he told us both that he had already authorized the return of my deposit and that he was surprised that my credit card account had not shown the credit yet. Your position that I would be receiving the deposit only when the vehicle has been sold is a clear breach of the verbal agreement I had with Justin, the written agreement I had with Camillo and the statement that Camillo made to Lexus. It is sad that you have absolutely no integrity and now are only willing to return my deposit should I agree not to post my comments on DealerRater. But then I am not surprised.

Last week when you called to say that you were refunding my deposit I received a fax of a credit card slip that showed you had charged me ANOTHER $500. I called your accounting office and they reversed the charge and faxed what appeared to be a credit card slip showing a credit of $500. The credit has yet to show up in my MasterCard account.
