Maier III 3453 Maritime Drive Toms River NJ 08753 Urgent Lemon Law Notification Toyota Corporate/Lou Hernandez GM Toyota Runnemede: I believe that my VEHICLE is a “lemon” under the New Jersey Lemon Law (N.J.S.A. 56:12-29 to 56:12-49). I am hereby making a written demand for relief under the Lemon Law. I purchased the 2020 Toyota Sequoia VIN #5TDJY5G17LS179311 on 09/15/2020 from Toyota of Runnemede NJ. Since I bought the vehicle, I have had to return it to a Toyota dealership a MINIMUM of 4 times and have had over 30 conversations with either a dealership service technician, or Toyota Brand Engagement with no solution. My vehicle has been out of service for repairs for a total of 45 calendar days. The vehicle has been at Toyota of Runnemede since 9/14/2022. I filed an official complaint with Toyota Brand Engagement on 07/13/2022 and I was told that Toyota of Runnemede would immediately take care of the problem. They intentionally stalled the attempted repair process for 2 months and only after repeated phone calls and my insistence, that they picked the vehicle up. 1. The issues began the day I purchased the vehicle and started driving home. The front end and steering wheel began vibrating so I called Toyota of Runnemede on the way home and they indicated the tires were likely out of balance. Since the issue was intermittent, I didn’t bring it to a dealership until there were 1700 miles on the truck. Gateway Toyota in Toms River NJ thought the issue was related to the tires being out of balance, so they balance the tires and returned the vehicle. The front end and steering wheel continue to vibrate. 2. I next returned the vehicle to Gateway Toyota in Toms River NJ on 04/28/2021 and they indicated that the issue was the front-end alignment, that they made me pay for since over 6 months had elapsed since purchase. This of course did not repair the problem and the wheel continued to vibrate. 3. Next, I returned the vehicle to Toyota of Runnemede NJ on or about February 2022 at which time the dealership kept the vehicle for over 2 weeks. While the technician indicated he was able to recreate the issue, no solution was offered, and the vehicle was returned to me. In addition, the dealership failed to repair the scratch on the rear decklid that was present since purchase, and they had promised to repair at a later date. 4. The issue continued and I called Toyota of Runnemede throughout the month of June 2022 and sent certified letters to the General Manager Lou Hernandez, and I finally received a call back at the end of June from John Schweir, the new Manager of Service stating he would take a deeper dive into the issue, and I would hear back from him soon. 5. Since I did not here back from the Service Manager, I filed an official complaint with Toyota Brand Engagement on July 13, 2022. At this time, I started receiving phone calls from John Schweir, who said he would set up an appointment to investigate my issue. I basically chased him all summer and simultaneously sent him videos via text message of the wheel vibrating to give him advance knowledge of the issue. 6. After chasing the Service Manager for nearly 2 months I finally insisted that the vehicle get picked up and they finally picked up the truck on 9/14/2022. I believe they were attempting to intentionally run out the clock on the lemon law. After keeping the vehicle for 10 days they advised me they thought the issue was the tired and recommended I replace all 4 tires with Michelins at MY EXPENSE. The ludicrous logic was I didn’t rotate the tires at a dealership, and the Cooper tires I had put on the vehicle 7 months ago were substandard tires and not the tires recommended by Toyota. This is laughable as the issue STARTED THE DAY I BOUGHT THE TRUCK and has continued without interruption for 39,000 miles. I was then contacted by Toyota to discuss the issue where I stated they could replace the tires at their expense if they wanted to rule them out, but I further stated it was a useless endeavor since the issue originated on September 15th, 2020. The representative at Toyota said that they could not pay for the tires, and they would have to be installed at my expense. I have purchased no less than 6 Toyota Vehicles at this dealership over the last 4 year for over 300,000 dollars and I sent my son their as well where he bought 2 Camrys for over 70,000. So, after spending a total of 370,000 at this dealership and only buying Toyotas since 1995 I was basically told that I could pound salt. This was the WORST CUSTOMER SERVICE EXPERIENCE OF MY LIFE. Clearly Toyota does not value my business and has no intention of repairing my truck. Since these defects substantially impair the use, value and/or safety of my vehicle, I am hereby allowing you one final opportunity to repair my vehicle under the New Jersey Lemon Law. If these repairs are not made within ten calendar days of receipt of this letter, I am entitled under the New Jersey Lemon Law to a replacement vehicle acceptable to me or a refund calculated in accordance with the Lemon Law.
