Painful Negotiation In October of 2018 I wanted to buy a 2010 RAV4 Limited from Nissan of Elk Grove. I liked it a lot, but wanted to make sure it was in good mechanical In October of 2018 I wanted to buy a 2010 RAV4 Limited from Nissan of Elk Grove. I liked it a lot, but wanted to make sure it was in good mechanical condition before I bought it, so I proposed that I have a factory-trained technician at my favorite Toyota dealership inspect it before I decided whether to buy it. The sales manager told me that he'd be happy to let my mechanic inspect the car at his dealership. I told him that no mechanic would either consent to come to the dealership or be able to do a thorough inspection of the car even if he did agree to come, and that I wouldn't buy the car if I couldn't take it to my favorite Toyota dealership to get it inspected by a factory-trained technician. The sales manager told me that there were only two ways that I could get the the car inspected that way. Both required me to buy the car before I could get it inspected at the Toyota dealership. The first option was to buy the car and exchange it within five days for another car of equal or greater value if the technician found something wrong with the car and I decided not to buy it. I didn't like that option, because it didn't guarantee me a good car - there was no way to be sure that the dealer had a make and model that was acceptable to me, and even if he did I would have no way to find out whether that car was broken. The second option was to buy the car and pay a fee of $225 for the right to return the car within three days if the Toyota technician found something serious wrong with it, but I'd have to pay a $500 restocking fee when I returned the car. I didn't like that option much either, but the sales manager was willing to lower the price of the car enough to cover both fees. I chose the second option, bought the car for $725 less than the dealer's asking price, and took the car to the Toyota dealership to have it inspected. The technician found defects that would cost about $1400 to correct. All four brakes had been repaired with after-market parts. It would cost about $900 to replace the after-market parts with OEM parts. I'd already noticed that the car vibrated when I braked, so it didn't surprise me that the brakes needed work. There were also two broken connections to the battery that it would cost about $500 to correct. The sleeve protecting one of the cables that connected the battery to the car's electrical system had been eaten through by rodents, and the connection to one of the battery's terminals was damaged. I had two possible courses of action available to me: (1) Return the car and pay a $500 restocking fee, or (2) keep the car and pay $1400 to fix the problems myself. I proposed the following compromise to the sales manager: that I keep the car and he and I split the cost of the repairs - each of us paying half. I would present the invoice containing the technician's description of the repairs and their exact cost to the sales manager, and we would each pay half the amount on the invoice. The dealer's payment could be made through reduction of the balance due for the car or through direct reimbursement. I reasoned that neither of us would have to give up too much in the deal - I would have the car and he would have the sale, but we would both have to give up $700 to make the deal. After a long and painful negotiation the sales manager agreed to the compromise deal. I think the compromise was much more than fair to him, and didn't like it when he kept trying to get more money out of me. I don't remember the name of the sales manager who sold me the car, and don't see it in the list provided below. Whoever he was he ge's the poorest possible performance rating. He was about as unfriendly as anyone I've ever dealt with. More
