An “as-is” disclaimer in a used car sale transaction communicates to the buyer that they are purchasing the vehicle in its current condition, without any warranties or guarantees from the seller. However, a car sold “as is” still has a warranty of good title, unless excluded by specific language or by circumstances that give the buyer reason to know that the seller may not have clear title. The “as-is” sale disclaimer does not provide a seller with blanket immunity from liability for fraud. Dealerships are required to display a Buyers Guide in the window of every used car on their lot, which tells the customer if the car is being sold “as is” and if there are any applicable warranties.
