DealerRater.com, LLC ("DealerRater" "we" "us" or "our") respects your privacy and the information that you have entrusted to us. This Privacy Notice (the "Privacy Notice") describes our information handling practices in connection with the website located at www.dealerrater.com and any other websites owned or operated by DealerRater ("Site"), and any other services offered by DealerRater ("Services").
This Privacy Notice does not describe DealerRater's collection, use, and disclosure of information through means other than the Site (e.g., off-line), the use of the Services, or the collection, use and disclosure practices of any affiliate or other third parties. How we collect this information:
- Directly from you when you provide it to us, including when you submit a review form, lead form, or other web form on the Site.
- Automatically when you navigate our Site (or an affiliated site). For example, from submissions through our website portal or website usage details (including without limitation IP address, device ID, geolocation data collected automatically).
- From third parties that interact with us in connection with the Services we perform. For example, we may ingest audience data from third-party data providers to power targeted messaging or customized services. We may also receive aggregated vehicle sales records for analytics and other purposes.
- From anti-fraud and other crime prevention partners.
You should not provide any information to us, whether via the Services or through the Site, unless you agree to the use of that information in accordance with this Privacy Notice.
2. How We Use Your Personal Information
We may use the Non-Personal Information we collect and obtain for any lawful business purpose without any duty or obligation of accounting or otherwise to you, provided that the information remains Non-Personal Information. This will include, by way of example, developing products, services, and other offerings based on the Non-Personal Information and providing those offerings to other users and third parties.
We may use the Personal Information we collect about you for a variety of purposes:
- To respond to an e-mail or message or particular request from you.
- To solicit feedback.
- To verify or enforce compliance with the policies governing our Site and applicable laws.
- To protect against misuse or unauthorized use of the Site.

Note that we may combine and enhance the Personal Information we collect and obtain about you with information we receive from third parties, provided that we use the combined information in accordance with this Privacy Notice. We may also use the Personal Information we collect and obtain about you to generate Non-Personal Information. When we do so, we will take reasonable measures to ensure that the Non-Personal Information is no longer personally identifiable and may not later be reasonably associated with, linked to, or used to identify you. This will include, by way of example, storing the Non-Personal Information separately from any Personal Information. Once we generate Non-Personal Information from any Personal Information, we will not later attempt to again make that information personally identifiable. However, we may combine and enhance that Non-Personal Information with other Non-Personal Information we receive or obtain from third parties.
3. Disclosure of Your Personal Information
We may disclose the Non-Personal Information we collect and obtain for any lawful business purpose without any duty or obligation of accounting or otherwise to you, provided that the information remains Non-Personal Information. This will include, by way of example, sharing that Non-Personal Information with third parties.
We may disclose Personal Information that we collect or you provide as described in this Privacy Notice:
- Affiliates and Subsidiaries. DealerRater may share your Personal Information with affiliates and/or subsidiaries in a manner consistent with this Privacy Notice.
- Service Providers. DealerRater may work with third parties that provide services on its behalf, including, among others, providers of analytical, attribution, development, promotional, research, credit card processing, technical, financial lending, legal, hosting services, and other services.
- As Needed or Requested. DealerRater may share Personal Information for any other purpose disclosed by us when you provide the information, or with your consent. If you affirmatively consent to being contacted via phone or SMS, you agree that DealerRater or other third party may use an autodialer to text or call, that a portion of any call may be pre-recorded, and that standard message and data rates may apply. All Text Messaging opt-in data and consent will NOT be shared with any third parties, excluding technology providers required to facilitate text message delivery.
- Dealerships. Dealerships who maintain DealerRater accounts may privately contact reviewers through our Site on items related to a consumer review. DealerRater facilitates the interaction through the DealerRater platform. Email addresses are not provided to either party without prior consent.
- Other requirements. DealerRater expressly reserves the right to release any Personal Information or other information you provide to third parties under the following circumstances: (a) when required by law or legal process, (b) to investigate and/or take action against illegal activity, suspected abuse or unauthorized use of the Site, (c) to protect the property or safety of our users or others, (d) to enforce our Terms and Conditions of Use or API license grant, and (e) in connection with any sale or other transfer of ownership of all or a part of DealerRater. Further, if you make any Personal Information publicly available on the Site, DealerRater reserves the right to disclose such information to third parties, including, without limitation, insurance companies and DealerRater’s affiliates and third-party distribution partners.
- Third Party Marketing. We have relationships with other companies that we allow to place ads on our Site. As a result of your use of the Site, such ad server companies may collect information such as your domain type, IP address and clickstream information. DealerRater may engage third parties to help us provide the Site and manage our business, although these organizations are subject to confidentiality obligations and may only use your Personal Information for the purposes DealerRater defines. We may share information with third-party marketing partners about how you browse and shop in order to show you ads for DealerRater or our advertising partners that are more relevant to your interests. We may use cookies and other information to provide relevant interest-based advertising to you.
- Ad Networks. We belong to ad networks that may use your browsing history across participating websites to show you interest-based advertisements on those websites. Currently, our Site does not recognize if your browser sends a "do not track" signal or similar mechanism to indicate you do not wish to be tracked or receive interest-based ads.

- Contact information, including your name, address, city, state, zip code, email address, and telephone number

- Communications with our support team

4. How We Protect Your Personal Information
Because the Internet is not 100% secure, we cannot guarantee that your use of our Sites and Services will be completely safe. However, we use reasonable administrative, technical, physical safeguards to protect your Personal Information. We also encourage you to use caution when using the Internet. We may link to other sites or outside party services on platforms we do not control. If you click on a link to an outside party site, you will be taken to websites or platforms we do not control. We are not responsible for their practices for protecting your Personal Information.
5. Use of Cookies, Web Beacons, and Similar Technologies
DealerRater uses cookies and pixels as automatic data collection mechanisms that collect information, including personal information, from users of our Website and services. Third parties also place these tools on our Website to collect and process information about our users for various purposes, including for security, for analytics, and to facilitate targeted advertising. By visiting our Website, or otherwise using our services, you consent to DealerRater's use of cookies and pixels, as detailed in our Cookie Policy.
6. Personal Information Retention
Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes for which we collected it, including as required to satisfy any legal, accounting, or reporting requirements, as necessary to resolve disputes, or as otherwise requested by you.
To determine the appropriate retention period for Personal Information, we consider our legal obligations, the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information, and whether we can achieve those purposes through other means. This duration varies based on data type and use, but we have recorded the durations in our internal records and information management policy and schedule.
7. Children
DealerRater does not knowingly collect or use any Personal Information from children under the age of 18. DealerRater does not knowingly provide any Personal Information, regardless of its source, to any third party for any purpose whatsoever from visitors younger than 18 years of age. No information should be submitted to or posted at DealerRater by visitors younger than 18 years old.

Please note that the Site may contain links to other websites. DealerRater is not responsible for the websites, content, or privacy practices of any third party. Where any links found on the Site link to pages not belonging to DealerRater, those external pages are not governed by this Privacy Notice. 9. Your State Privacy Rights
This section applies solely to individuals who reside in the following states: Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Rhode Island, Utah, and Virginia. Unless specific states are noted below, the following rights apply to residents of each of these states. To exercise any of the rights described below consistent with applicable law, please follow the instructions provided below. All consumer requests must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized agent of such a person. The verification steps will vary depending on the sensitivity of the Personal Information and whether you have an account with us.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot fulfill your request or provide you with Personal Information if we cannot verify your identity or confirm an agent's authority to make the request on your behalf. We will only use Personal Information provided in a consumer request to verify the requestor’s identity or authority to make the request.
An authorized agent may exercise your rights on your behalf. We may request that your authorized agent submit proof of identity and that they have been authorized to exercise your rights on your behalf. We reserve the right to reach out to you directly in order to confirm that they authorized agent is permitted to act on your behalf. We may deny a request from your authorized agent to exercise your rights on your behalf if they fail to submit adequate proof of identity or adequate proof that they have the authority to exercise your rights.
- Data Access Request. You may request that we disclose certain information to you about our collection and use of Personal Information. Subject to certain exceptions, you can also request a copy of your Personal Information. Oregon residents may also request a list of third parties to whom we have disclosed Personal Information. We will provide a copy of this information in a standardized and commonly used format.
- Deleting your Personal Information. You can request that we delete Personal Information we have from or about you, subject to certain exceptions.
- Correcting your Personal Information. Residents of Colorado, Connecticut, Delaware, Indiana, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Rhode Island, and Virginia have the right to request that we correct inaccurate personal information, considering the nature of the personal information and the purposes for processing the personal information.
- Opting Out of Communications. Our promotional materials include instructions for opting out of receiving further communications. If you no longer wish to receive promotional emails, you may opt out by contacting us with your request at the contact information listed below. Please note that even if you opt out of receiving marketing communications, we may still communicate with you regarding an established business relationship, if one has been established. Please allow a reasonable time after reaching out for us to process your request.
- Opting Out of Analytics Tools. You may opt out of having your data used by Google Analytics via Google's Ads Settings, Ad Settings for mobile apps, or any other available means. Please visit policies.google.com/technologies/partner-sites for more information on how to do this.
- Adjusting Cookie Settings. Most browsers accept Cookies until you change your browser settings. If you do not wish for the Site to collect your information using Cookies, you can typically disable the use of Cookies (or disallow the use of Cookies on specific websites) by changing your browser settings. - Opting Out of Targeted Advertising. We may use Personal Information obtained (or in some instances inferred) from your activities across unaffiliated sites to send more relevant advertising to you. Furthermore, residents of Utah and Iowa have the right to opt-out of the processing of their Sensitive Personal Information.
- Appeal. If we deny your request or refuse to take action on our request, residents of Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, and Virginia have the right to appeal within a reasonable time of receiving our decision. Within 60 days of the receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. You may contact your state's attorney general if you have concerns about the result of the appeal.
Please note that the above rights are not unqualified, we may be entitled to refuse requests, wholly or partly, where exceptions under applicable law apply.

Nevada
If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. Please note that we do not currently sell your Personal Information as "sales" are defined in Nevada Revised Statutes Chapter 603A. Nevada residents who nonetheless wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to privacy@cars.com.
10. Notice to California Residents
If you are a California resident, state law may provide you with additional rights regarding our use of your Personal Information. To learn more about your California privacy rights, please visit DealerRater's California Privacy Notice.
In addition to the rights discussed in the Privacy Notice for California Residents, if you reside in California, you also have the right to ask us one time each year if we have disclosed Personal Information to third parties for their direct marketing purposes. 11. Notice to Canadian Residents
If you are a Canadian resident, federal and provincial law may provide you with additional rights and information regarding our use of your Personal Information.
Transferring Personal Information
We may process, store, and transfer your Personal Information in and to a foreign country, including the United States, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this notice and applicable Canadian privacy legislation. You are welcome to contact us to obtain further information about our policies regarding service providers outside of Canada.
By submitting your personal information or engaging with the Sites and/or Services, you consent to this transfer, storage, and/or processing.
Accessing and Correcting Personal Information

Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
Withdrawing Consent
Where you have provided your consent to the collection, use, and transfer of your Personal Information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, contact us at privacy@cars.com. Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. 12. Notice to Non-US or Canada Residents
These Sites and Services are intended for use solely in the United States (including its territories and commonwealths), and Canada by U.S. and Canadian residents. We make no claims that the Sites and Services are appropriate for use outside of the United States or Canada. DealerRater does not knowingly collect or solicit Personal Information from residents of the European Union. If you believe that we may have any information from or about an EU resident, please email us at privacy@cars.com. No information should be submitted to or posted at DealerRater by any EU resident.

We reserve the right to update and periodically amend this Privacy Notice at our discretion and at any time. If we make changes to this Statement, amendments will be posted online and the date of update will be included. We collect information that is linked or reasonably linkable to an identifiable individual and does not include de-identified data or publicly available information (“personal information“). 2. Your Rights.
A. Right to Access and Data Portability
You have the right to confirm whether Company is processing personal information and to access this personal information. You may obtain the information in a portable and readily usable format, to the extent technically feasible.
B. Right to Correct
You have the right to correct inaccuracies in your personal information, taking into account the nature of, and purposes for, processing the personal information.
C. Right to Delete
You have the right to delete your personal information.
D. Right to Appeal Consumer Rights Request Responses
You may appeal Company’s refusal to take action on your consumer rights request within a reasonable time after you received Company’s decision. We will endeavor to notify you within 45 days of receipt of your appeal (and we will notify you if Company requires an additional 60 days) what action Company has taken in our written response. You may contact the state Attorney General if you have concerns about the result of the appeal.
E. Right to Opt Out
You have the right to opt out of your information being processed:

• For the sale of personal information, or

F. Right to Consent to the Processing of Sensitive Personal Information

Connecticut
This supplements the information contained the Privacy Notice and applies solely to individuals who reside in the State of Connecticut. If you are a Canadian resident, federal and provincial law may provide you with additional rights and information regarding our use of your Personal Information.
Transferring Personal Information
We may process, store, and transfer your Personal Information in and to a foreign country, such as the United States, which has different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your Personal Information through the laws of the foreign country. We may use service providers in other jurisdictions as described in this Privacy Notice. You are welcome to contact us to obtain further information about our policies regarding service providers outside of Canada. By submitting your Personal Information or engaging with the Site and/or Services, you consent to this transfer, storage, and/or processing.
Accessing and Correcting Personal Information
It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your Personal Information changes. By law you have the right to request access to and to correct the Personal Information that we hold about you. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
Withdrawing Consent
Where you have provided your consent to the collection, use, and transfer of your Personal Information, you may have the legal right to withdraw your consent under certain circumstances. Other International Residents
This Site and Services are intended for use solely in the United States (including its territories and commonwealths) and Canada by U.S. and Canadian residents. We make no claims that the Site and Services are appropriate for use outside of the United States or Canada. DealerRater does not knowingly collect or solicit Personal Information from residents of the European Union, United Kingdom, Switzerland, or any other jurisdiction other than the U.S. and Canada. If you believe that we may have any Personal Information from or about a non-U.S. or Canada resident, please email us at privacy@cars.com. No information should be submitted to DealerRater by any resident from outside of the U.S. or Canada.
Exercising Your Rights
Depending on where you live, the rights described in this supplement may apply to you. To exercise your rights compatible with applicable law, please submit a verifiable consumer request via 800.266.9455 or privacy@cars.com.
A. Verifiable Consumer Requests
Your verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected information, and describe your request in sufficient detail that allows us to properly respond to it. We cannot respond to your request if we cannot verify your identity and confirm that the information relates to you.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us via the methods noted above. If you are a California resident, you can designate an authorized agent to make a request on your behalf only if: (1) the authorized agent is a natural person or a business entity registered with the Secretary of State of California; and (2) you sign a written declaration that you authorize the authorized agent to act on your behalf. If you use an authorized agent under California law to submit a request to exercise your rights, please have the authorized agent take the following steps in addition to the steps described above:
• Mail a copy of your signed written declaration authorizing the authorized agent to act on your behalf; and• Provide any information we request in our response to your email to verify your identity. The information requested will depend on your prior interactions with us and the sensitivity of the personal information at issue.
If you provide an authorized agent with power of attorney pursuant to California Probate Code sections 4121 to 4130, it may not be necessary to perform these steps and we will respond to any request from such authorized agent in accordance with the CCPA.
California, Iowa, Kentucky, Minnesota, Nebraska, Tennessee, Texas, and Virginia residents may make a verifiable consumer request twice within a 12-month period, free of charge, unless the request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. Colorado, Connecticut, Delaware, Indiana, Maryland, Montana, New Hampshire, New Jersey, Oregon, Rhode Island, and Utah residents may make a verifiable consumer request, free of charge, once within a 12-month period; subsequent requests from residents in these states may warrant a fee.
B. Response Time
We will respond to verifiable consumer requests within the time allotted under applicable law, generally forty-five (45) days of its receipt. If we require more time (up to 45 days), we will inform you of the reason and extension period in writing in compliance with applicable law.
C. Response Content
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance in compliance with applicable law.
D. Method of Response
You do not need to create an account with us to make a verifiable consumer request. However, if you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
