This finance manager illegally ran my credit without my authorization. I applied for an auto loan directly with Honda Financial. When I received an email with the finance decision I was not able to access authorization. I applied for an auto loan directly with Honda Financial. When I received an email with the finance decision I was not able to access the results. Per the email, which stated if there is an issue accessing the results contact a local dealer to get the results. It also stated “Do Not Submit Another Application”. I called Ed Martin Honda and spoke with Orlando, explained what the email said and provided him with the code provided by Honda Financial. I was not able to get any information from the dealership, they were attempting to get me to come to the dealership and was not interested in providing me with the information I called about. About a week later as I am reviewing my credit report I find an inquiry from Ed Martin Honda. I never provided any of my personal information, nor did I authorize anyone to run my credit. Submitting a credit application without the parties consent is illegal under both Federal and Indiana Law. Identity Theft and Fraud (18 U.S.C. subsection 1028): Using someone’s personal information without their consent to apply for credit can be considered identity theft, which is a federal crime. The identity Theft and Deterrence Act prohibits unauthorized use of someone else’s identity to obtain credit or other financial benefits. Fair Credit Reporting Act (FCRA, 15 U.S.C. SUBSECTION 1681) This federal law requires that a credit application and credit inquiries be made with the consent of the individual. Unauthorized applications can lead to improper credit checks, which violates this act. Indianapolis State Law Violations: Identity Deception (Ind. Code subsection 35-42-5-3.5) In Indiana, using another person’s identity without consent for any financial gain, including submitting a credit application, is considered identity deception, a serious criminal offense. Deception and Fraud (Ind. Code subsection 35-43-5-3) This statute makes it illegal to knowingly or intentionally mislead a financial institution or other entity by submitting a fraudulent application or making a false statement, Civil liabilities, including damages or penalties under the FCRA for unauthorized credit inquiries, as well as criminal charges for identity theft or fraud, which can include fines and imprisonment are the results of fraudulently applying for credit. I have filed a complaint with Honda Customer Service and will be filing a police report with the hopes of the arrest and prosecution of Sheldon Gottlieb and Orlando from sells. More
