I reached out to BMW El Cajon to inquire about purchasing a BMW X3 M40I. Initially, I was informed the car was available, then told it had been sold, and later told it was available again, which led to a lot a BMW X3 M40I. Initially, I was informed the car was available, then told it had been sold, and later told it was available again, which led to a lot of confusion. After receiving walk-around videos from the salesperson, I decided to commit to buying the car for approximately $47,000 in cash. As an out-of-state buyer from Montana, I don’t need to pay sales tax on such a purchase due to Montana's tax benefits. I informed the dealer that I would cover the cost of the car, have them send me the title, and have my assistant register it, a process we’ve done many times before. Once titled, I planned to arrange for the car to be picked up. During our discussions about delivery, I mentioned spending winters in Arizona, and the sales manager, Chris, kindly offered to drive the car to Yuma, Arizona, for me to take delivery, which I accepted. I was then directed back to the salesperson to finalize the paperwork. I provided them with my driver’s license and proof of insurance, but then received a credit application. I clarified that I planned to pay in full with cash and wasn’t seeking credit. The salesperson explained that the credit application was to verify my identity. I expressed my concerns about using a credit application for this purpose as it required sensitive information like my social security number and employment details, potentially authorizing them to secure credit on my behalf. I refused to complete the application, citing advice from my family attorney, who stated this approach was inappropriate and risky. He mentioned that it’s standard to run a check through the Office of Foreign Asset Control, but not to use a credit application for identity verification. I emailed the dealership management that evening to address the situation, with my attorney’s assistance. The following morning, a manager called to inform me that they would no longer sell me the car because they found me "too difficult to work with." As a woman, I perceived their tone as demeaning and discriminatory. It seemed my refusal to fill out the credit application and challenging their process led to their decision. When I spoke with Anthony, the General Sales Manager, he cited problems with registering the vehicle, although I clarified this was not their responsibility. He claimed buying a car sight unseen wasn’t appropriate, although I had received detailed videos and it was ultimately my decision to proceed. He also expressed concern about delivering the car to Yuma, despite this being their offer. His reasoning seemed inconsistent, especially since the car would be legally mine once the paperwork was signed and payment made. This transaction felt suspicious, possibly because I leveraged Montana's tax rules or refused to sign an inappropriate credit application. In a market flush with vehicles but short on buyers, especially cash ones, their excuses for turning down a sale did not make sense. This issue isn’t over, I will be pursuing my legal rights. More
