The good, the bad, the ugly. The good- the car I found on line, and wanted. It was a great deal- below market value because it had been a repaired car from an accident. When I got there, it was there, was in nice shape, and I think dollar wise it was a good value for the money. The bad: Well, the first thing is - they wanted my SOCIAL SECURITY NUMBER. I don't usually give that to anybody who doesn't have a legal authority to have it. They REFUSED to sign off the title to me, unless I gave them my SSN. They said it is required under Ohio law. (It is not- it is required to OBTAIN AN OHIO TITLE, but I am a Michigan Resident, so it should not have been necessary to sign off the old title as a title release. We argued, eventually I relented. The UGLY: That said- it turns out that they used my Social Security Number not for the title, but rather for some kind of "FINANCE query". AND they used it to check the Office of Foreign Asset Control (OFAC). Not required by law to use SSN for that, but they had no other alternative. There is NO legal requirement for them to take my Social Security number to comply with the OFAC law. Sorry, but they don't know WHY they need my SSN, only that they would not sell me a car until I disclosed my SSN to them. I will NEVER buy a car in Ohio again because I don't trust any car dealer with my information. (Note - I was paying with cash- did not need a loan, so I should not have been credit checked, NOR should they have my SSN for the OFAC. ) Finally, the rest of the UGLY: AFTER they ran my ID to confirm I wasn't someone other than whom I said I was, and AFTER we agreed on a price for the car, and terms for the sale- they demanded that I sign a form surrendering my rights to legally appear in Court, and give them authority to use an Arbitration Agreement instead. Now- I got burned years ago by one of those "mandatory arbitration agreements". So today I am absolutely allergic to them. I have NEVER sued anybody. I have been twice sued myself in my life. Once I had an arbitration agreement sign off, and once I did not. I will NEVER sign one willingly again. So when the guy pulled it out in my package of closing documents, I refused to sign. I point out to him that The 7th Amendment to the Constitution guarantees all Citizens a right to have a civil case in dispute before an actual jury. You can't FORCE someone to enter an agreement that negates a court appearance. So they called the owners, and the owners refused to relent. The owner said if I wanted to buy the car, I had to sign the form. So I turned it back on them. After the owners hung up the phone, I signed the form, (which is what they said I had to do) and then I wrote in big block letters over the printing on the form NO and circled it. I met their requirement my signing the form. I protected myself, in that if they ever try and sue me, I can pull out my copy of the form and explain to the judge that I never willingly gave up my rights under the Constitution. I hope we never have to see this play out. Bottom line- 1. . Yes, they had the car. 2. It was a good deal. 3. If they hadn't been such jerks about the Social Security Number junk, and the Arbitration agreement demand, I would have given them FIVE STARS. But because if this stuff, I dropped them at least two starts. If you find a car there- call and make sure it is still there before you go. And be prepared to give them information they don't legally require. If you are ok with that- go for it. If not- save yourself the trouble and shop in Michigan instead. Kudos to Gary Gertz for excellent communication, knowledge, and no pressure. Corey was ok- he had to do what he had to do to close the deal. That's what he is paid for, and that is what he did. Big fat zero for the company owners who failed to understand their customers who don't want to give up personal information to simply buy a car, and for insisting on arbitration agreements in violation of the Constitutional protection against such clauses. Yes, I bought the car. No, I will never buy another one in Ohio, or from this dealership owner. More
