Excessive Charges and Unfair Appraisal: 1. Total Cost of Repairs and Diagnostics • To date, I have paid $1,848.77 for diagnostics and repairs at your dealership, trusting that I would recei Total Cost of Repairs and Diagnostics • To date, I have paid $1,848.77 for diagnostics and repairs at your dealership, trusting that I would receive honest and quality service. • However, the manipulation of diagnoses and the lack of transparency in the charges call into question the legitimacy of these payments. 2. Appraisal of my 2016 Nissan Rogue SV/AWD • Recently, I consulted with Nissan's new and used vehicle sales area. • After speaking with the salesperson on duty, I was informed that the appraisal of my vehicle is only $3,000, based on an alleged depreciation due to “previously reported crashes.” • This appraisal was previously reviewed by the sales manager, who used this justification to minimize the value of the vehicle. • This is completely unfair, since I was not the original owner of the vehicle since March 2016, but rather acquired it in September 2022. • In addition, my vehicle recently passed an inspection in which it was confirmed that the engine is in good condition, which contradicts any argument of extreme depreciation. This demonstrates a clear pattern of unfair practices, in which they have not only made abusive charges for diagnosis and labor, but are now trying to undervalue my vehicle with arbitrary justifications. Video Evidence and Open Challenge If the seller continues with his evasive and manipulative attitude, I publicly challenge him before the Champaign police to submit us to a polygraph to determine who is telling the truth and who is manipulating the facts. In addition, there is video evidence from the establishment's security cameras that support my version. These recordings show: • My arrival and wait time at the dealership. • The interactions I had with employees. • The facial expressions and body language of employees. That employees take responsibility and state the truth of the facts without manipulating the narrative in their favor. That they remain neutral, professional, and control their emotions, rather than reflecting on their faces the anger and frustration of having been exposed in their bad practices. Legal Violations and Possible Penalties: Your dealership is incurring potential violations of Illinois consumer protection laws and federal fair trade regulations. Applicable regulations include: 1. Illinois Consumer Fraud and Deceptive Business Practices Act (815 ILCS 505/) • Prohibits deceptive business practices, including fraudulent billing and false representations about services rendered. • Manipulating diagnoses to generate additional charges could be considered consumer fraud. 2. Motor Vehicle Repair Act (815 ILCS 306/) • Requires dealers and repair shops to provide transparency in their diagnoses and costs. • Refusing to release my vehicle until I pay a questionable fee may be construed as wrongful retention of property, which could lead to a criminal investigation. 3. Federal Trade Commission (FTC) Act - Section 5 • Prohibits “unfair or deceptive practices in trade.” • Misleading advertising about repair costs or retaliation against customers who make public complaints could be investigated by the FTC. 4. Violation of Consumer Rights and Anticompetitive Practices • Refusal to provide me with service in retaliation for exercising my right to publicly complain is a potentially discriminatory and delaying practice, which could lead to sanctions by the Illinois Attorney General’s Office. Possible Legal Actions: Since your dealership has refused to act transparently, I reserve the right to file formal complaints with the following entities: 1. Illinois Attorney General’s Consumer Protection Division 2. Federal Trade Commission (FTC) 3. Better Business Bureau (BBB) 4. Illinois Department of Consumer Affairs 5. Illinois Department of Motor Vehicles (DMV) 6. Local and State Police in case of wrongful detention or fraud I demand immediate reimbursement of $182.50 and a clear response correcting this injustice. More
