Sheehan Cadillac responded

Hello, In your situation, you purchased a vehicle then decided you did not want it anymore and asked us to cancel the deal. This was not an option. We proceeded to provide a way out by purchasing back the vehicle for more than you paid for it, you would only have to cover the fees such as tax, tag, titling, etc. You agreed and provided an additional $1,744. It was made clear by providing this check we would be purchasing your vehicle and you would fulfill your contractual obligation with the lending institution. At that time you completed paperwork agreeing to sell us your vehicle. We came up with the additional $1,744 by taking the total financed amount and subtracting the price we were purchasing the vehicle for from you. We hope this clears up any confusion you may have regarding this transaction.

THE SMALL MAN WINS!!! I took Sheehan to the small claims court and WON, they paid me back the full amount of money. It must have cost them much more than the $1,744 they paid me back as their attorney fees must have been a lot. I wish they just did the right thing from the start and I did not have to go through all of this and leave a really bitter taste in my mouth. I will never buy a vehicle from Sheehan nor recommend them. Your response does not clear up any confusion; Eric Trouillot, the salesman that sold me the vehicle called me to inform me that the deal had already been processed by the bank and that it cannot be cancelled and would cost me $1,744.00 for Sheehan to purchase the vehicle back from me. This was a lot of money to lose especially as I never even took delivery. I had no choice and paid the $1,744.00. Following this I stopped payment of the deposit check. I requested numerous times a breakdown of how the $1,744 was calculated and was not provided. Later I got a call from Eric and the sale manger Kirk Rowdan who told me it was illegal to stop payment on a check in the state of Florida and threaten me with legal action and that this would negatively affect my immigration status. Both these statements are not accurate and was very offensive as Rowdan does not know my immigration status and should not unjustifiably threatening me with legal and immigration actions. I then contacted the bank to confirm that I was not liable for the monthly payments and spoke to Arthur Hoogmoed, the VP at Valley National Bank who informed me that the transaction was never processed, retracted and cancelled. Once I heard that the deal was never processed by the bank and in fact I never owned the vehicle and therefore I could not have sold the vehicle back to Sheehan, I contacted Eric Trouillot the salesman informing him of the situation and asking for a refund of the $1,744.00 paid. Eric responded by saying the payment was to get me out the deal and if I wanted to pursue this any further again threaten legal action. I am hoping we can resolve this matter amicably. I am hopping this can be resolved by the end of August,if not, I will consider all my options including social media and taking Sheehan to the small claims court. .
