Dear Ms. Brady, As you can expect, theft is a battle we’re constantly fighting on a dealership lot. We were as displeased to learn about the theft as you were. Thankfully, as you know, the police caught those responsible and the wheels were returned without damage. After thoroughly inspecting the vehicle and finding no damage, our service department put the wheels back on your vehicle and returned it once the requested work was performed. When your vehicle was picked up from Weymouth Honda, it was in the same condition as when it was dropped off, it had the original wheels, and tires on it, and the total repair cost was $0. I talked with the sales manager to discuss the condition of your vehicle upon delivery. To the point that it had 223 miles on it, I assure you that your vehicle is still considered a new car. We have attached an article from Ask a Lawyer Online citing Chapter 90D section 7 of Massachusetts General Laws. In order to get you your choice of colors, we made it clear that we would need to swap it with another dealer. We happily did this at no additional cost to you, so that you could get the car you want. It also happened to be the only vehicle in the specific trim/color combination in New England, so there were no options available with lower mileage. As you mention in your letter, we rectified the floor mat situation by apologizing and giving you a complimentary set of all season floor mats for our mistake. We also offered to reclean and detail your vehicle, as we value your satisfaction. I wanted to clarify a few points that seem to be misunderstood. We’ve had a few sets of wheels stolen from new and used vehicle from our lot in recent months. When you talked with our General Manager Jason Tobias, he originally confused the incident involving your car with an incident involving one of the used cars on our lot. We apologize for the confusion this caused, but it explains the inconsistencies. While we empathize with having wheels stolen off your new car from your office parking lot, we cannot be held responsible for your wheels being stolen from a garage near your work. I can understand your frustration with the situation, but neither you nor Weymouth Honda is responsible for the wheels being stolen. Wheel locks may have prevented the theft, but the thieves are the responsible party for your stolen wheels.
