On July 10, 2026, I entered into a conditional vehicle sales transaction with Lexus of Louisville for a 2019 Camry. On July 23, 2026, the dealership notified me via email that an outside lender rejected the loan due to an "income mismatch calculation," claiming the application data did not match my actual pay stubs. Because the dealership possessed my physical pay stubs from day one, they had actual knowledge of my income. They either entered inaccurate figures into the credit terminal or failed their administrative duty to accurately verify data before executing a spot delivery.Upon receiving an urgent written demand to return the vehicle, I immediately complied. However, the moment I successfully demanded and received my full $4,000 down payment back, the dealership immediately phoned me to state they had suddenly "found another bank." This alternative loan was offered at an extra $30 per month. This constitutes an unethical yo-yo financing tactic, leveraging an administrative data mismatch to pressure a consumer into a higher monthly rate after a deal was finalized.Consumer's Desired Resolution:| successfully forced the dealership to sign a mutual contract release and issue a full $4,000 merchant refund on July 23, 2026. Therefore, I am not seeking financial compensation. I am filing this complaint regarding their marketplace ethics. I request that executive management review the credit application data-entry logs for this transaction, discipline the finance staff involved in mismanaging my income data, and institute mandatory compliance training regarding spot delivery practices so future consumers are protected. The dealership’s attempt to shift 100% of the blame onto a third-party lender is a textbook deflection. The lender did not write the contract, nor did the lender force a "spot delivery" by releasing the vehicle before securing final, binding loan approval. The dealership’s finance department chose to engage in an unethical "yo-yo financing" tactic to pressure a consumer into a higher monthly rate after a deal was finalized. An apology for "confusion" does not address the underlying lack of marketplace ethics. I demand that executive management formally audit the credit application data-entry logs for this transaction, discipline the specific finance staff involved in mismanaging my data, and implement mandatory compliance training regarding spot delivery practices. This complaint will remain unresolved until actual internal accountability is taken. Be very careful if you sign a "Financing Contingency and Conditional Delivery Agreement" with this dealership. According to their own contract terms, if financing falls through, they are legally required to notify the customer by the close of business on the second day following the deal.I signed my agreement on July 10th, meaning their contractual deadline to notify me was July 12th. Lexus of Louisville did not contact me until July 23rd—thirteen days later. While I have already returned the car and successfully received my money back, waiting nearly two weeks to notify a customer is completely unacceptable and a direct violation of their own contract rules. Double-check everything you sign here and hold them strictly to their timelines. More
