UPDATE: Customer also made same complaint with the BBB, who investigated the issue and dismissed it following our response shown below: "I have read your complaint and would like to respond. We certainly would never want a customer to be upset purchasing or locating a vehicle. We did receive a deposit on 12/14/14 and gave you a copy of the purchase and sales agreement. The dealership did indeed swap in an incoming vehicle that is due to arrive here by the 15th of January. The agreement does state that the dealership can retain the deposit if the order is cancelled; however, I would never intentionally keep a customers deposit and would have liked the opportunity to speak with you before I received this complaint because you would have received a refund much sooner. I do apologize for whatever reason you decided not to purchase and wish you luck in whatever vehicle you do end up purchasing. Please contact me at 603-668-2411 to process your refund." Todd Berkowitz, Owner --- The refund was processed once the issue became known. Despite the wording on the Purchase and Sale Agreement that states that the dealership "can" retain the deposit if the order is cancelled, as the owner of Manchester Subaru, I have always chosen not do so.
