We sold a 2005 Mini Cooper S with just over 109,000 miles to a couple in Atlanta, Georgia. The husband represented himself to us as a business owner who had worked as a car salesperson in his past. He represented himself as quite knowledgeable about all aspects of the car buying process including “AS IS” sales. The car was advertised on the internet with over 20 pictures.   The husband contacted us about this vehicle and was concerned about the tires. In answer to his concerns the salesperson prepared and emailed a video featuring the tires and wheels. After reviewing the video, and with full knowledge that the car was being sold “AS IS” the customer decided to proceed with the purchase of the vehicle. I am attaching a copy of the signed Buyer Guide which clearly indicates that any repairs to the vehicle are solely at the expense of the buyer.   Several days after taking the delivery of the car the husband contacted us complaining about roof dings. We told him the car was purchased “AS IS” but if he wanted to get an estimate and send it to us we would review it. He told us he went to a dealer friend (where he worked as a car salesperson) to see about an estimate. The dealer told him to go see a friend of the salesperson to obtain an estimate. Then he could send the car back to us and the dealer would sell him a different 2005 Mini Cooper for $12,000 with fewer miles. The purchaser did in fact go to the dealer recommended glass and body shop where he obtained a ridiculously high estimate to make the repairs. It was obvious that the dealer and the purchaser were working together to get an inflated estimate so he could return the car and purchase the one his dealer friend had obtained.   As a gesture of goodwill we did in fact extend an offer to the purchaser to provide him with $400.00 toward the correction of the roof dings. We also offered to cancel the deal and have the vehicle shipped back to us at our expense verbally and in writing. We sent offer to him by Fed Ex overnight. He refused both options and demanded that we pay his shipping costs as well. We told him we would not reimburse him for his shipping costs. The next day as a further gesture of goodwill we offered to cancel the deal, have the vehicle shipped back at our cost and pay half of his shipping costs. The offer was structured as follows. We would cancel the bank loan the buyer had obtained at our expense, we would pay the return shipping costs and then refund his $2000.00 deposit on the same credit card he placed it on and send him a check for $275.00 for half of his shipping costs once we received the car back. We also asked the customer to send us some pictures of the damages to the vehicle which we have attached.   The seller refused this offer and wanted us to send him the money first before he would release the car. We explained to him we had to credit it back to his card and would not do so until we received the vehicle. He then informed us he had put 1000 miles on the car in approximately 10 days and would not allow the car to be shipped back until he was paid. We believe this excessive mileage after claiming to have an issue with the car is acceptance of the vehicle in the condition it was delivered. After reviewing the customer’s photos, we decided to withdraw all offers and call the sale final. The combination of the excessive mileage, lack of damage attested to by the customers own photos and the customers unreasonableness led to this decision. It is not reasonable to claim there is a problem and continue to drive the vehicle. We are not willing to make any further offers to this customer.
