I experienced blatant fraud at Fitzgerald Toyota Gaithersbur I purchased a used 2016 RAV 4 hybrid from Fitzgerald Toyota in Gaithersburg on 6/3/2020. At the time of purchase the agent offered a AUTOCHECK disclo I purchased a used 2016 RAV 4 hybrid from Fitzgerald Toyota in Gaithersburg on 6/3/2020. At the time of purchase the agent offered a AUTOCHECK disclosure form for my signature that indicated that the car was accident free. I had been told earlier that car had a rear quarter panel replaced due to very minor damage. I asked why that did not show up on the report. Ali , the sales person, indicated that the damage was so minor that no report was issued. I signed the disclosure. After 7 days, on 6/11, I found a CARFAX report in the car that indicated it had been in an accident sustaining damage on both front quarterpanels, the rear quarterpanel and functional damage. I consider this an overt attempt to defraud me; I made clear on several occasions that I was not interested in purchasing a car that was subject to mechanical damage. The used car manager, Curt Smith and the GSM, Phil Formichelli, insisted that the oversight was inadvertent and quickly offered to rescind the purchase. They both insisted that the car had mechanical integrity without disclosing what damage had been sustained. I told them that if that was true, I would accept a warranty to cover any problems. They refused. Obviously the accident damage makes this vehicle worth less than the purchase to which I agreed. Complicating matters, I had traded in my Honda Pilot and had already returned the tags to the MVA. They refused to retag the Pilot so that I could drive it home. To add insult to injury, Mr. Smith indicated that if I was going to return the car, I needed to have it there within less than 48 hours from the time I discovered the fraud, which is impossible given my employment schedule. At this point, I am in the process of contacting the owner in hopes of sanction for those who willfully attempted to perpetrate this fraud. More

Dealer where we purchased the vehicle was defensive and somewhat disinterested in pursuing a repair. I was advised by Toyota Corporate Customer Care to visit Fitzgerald Toyota for help. There I met Rob Gordon , a senior mechanic, who drove the car and heard the noise and advised me that Toyota would identify a fix. At a later date I met Gil Briggs, the service mgr. He was very busy but listened to me for at least 30 minutes. He asked me to leave the car so he could drive it. He heard the noise but Toyota had not identified a new replacement part. Months later I received a phone call at home from Mr. Briggs. He told me he just received a new TSB from Toyota that he believed would fix the problem. HE CALLED ME THE SAME DAY THE TSB WAS ISSUED BY TOYOTA !!! I brought the car in and a new electro-mechanical clutch assembly in the transfer case was switched out to eliminate most but not all the noise. Messrs. Gordon and Briggs are top notch. You will not find better service anywhere else. I still have not heard from the original dealer. For a busy service mgr at a major dealership to call me MONTHS LATER ON THE SAME DAY THE TSB WAS ISSUED is simply unexpected and greatly appreciated.. These gentleman are master mechanics and master customer service professionals. I am 76 years old, the son of a mechanic, and know a little more about mechanical operations than the average owner. These gentleman are the best I have ever dealt with and I highly recommend them More
