Good afternoon Kimberly. We are sympathetic to your dilemma. We note, however, that your claim that Dealer made “very clear” that you “would be covered” under Dealer’s insurance is simply not accurate. At the time of your transaction, you presented Dealer with a Texas Liability Insurance Card indicating that you had vehicle insurance coverage through Progressive County Mutual Ins Co. You also signed an “Agreement to Furnish Insurance Policy,” which provided, in relevant part, that: 1. Customer agrees “to furnish his/their own Insurance Policy”; 2. Dealer was not required to procure insurance on Customer’s behalf; and 3. Customer would “assume any and all responsibility for damage to the vehicle or resulting from the use, maintenance or operation of the vehicle, and agreed to hold [Dealer] free of any loss, claim, or liability resulting from any damage to the vehicle or from the vehicle’s use, maintenance or operation.” Additionally, you signed a “WE OWE” document that indicated Dealer did not owe anything other than the vehicle purchased, including insurance coverage. Dealer notes that Texas insurers generally extend a grace period to consumers purchasing vehicles depending on their coverage, typically allowing consumers a grace period of 7 to 30 days to update their policies. The issue of whether coverage applies in this case, however, is a question for you to resolve with your insurance, and not with Dealer. Thank you.
