Hello GP, There is nothing deceptive nor underhanded about this promotion. Every customer who comes into the dealership wins a prize. EVERY. SINGLE. CUSTOMER. We do NOT require a consumer to leave a name NOR a Social Security number unless the consumer wins a prize in excess of $600. We sent out 60,000 mailers, and, as clearly stated in the flyer, there is one winning number for each of the main prizes included in the 60,000 mailers. For example, on the Jeep Cherokee, the odds of winning are 1 in 60,000. Every consumer who has visited the dealership has left with a prize. No consumer has been forced or even asked to purchase a product in order to win a prize. This flyer and contest are in accordance with Pennsylvania law. Every condition is clearly spelled out in the flyer. No purchase is necessary to win, and if a consumer brings in a flyer while not wishing to give us ANY information, we are still more than happy to check to see what he or she has won.

It's interesting that you point out that your flyer is "in accordance with PA law" I take that to mean that you know it is intentionally deceptive but still allowed by law. It would be a good idea to ensure your employees to not ask for peoples personal information and SSN (as I WAS asked) before they revealed to them what exactly they have "won" ($2 scratch off lottery ticket). I agree the odds of winning are printed very small under each item but when the numbers in the scratch off list the numbers below a big prize item it is designed to give the person the impression that they have won that specific item, after all that's how most lottery ticket scratch off's work. I am all for businesses promoting themselves, but using trickery is a good way to lose potential customers. I have read that there are lawsuits in other states against this type of deceptive advertising. Perhaps when you get enough upset customers you will think twice about using trickery as "advertising".

You are, once again, deciding something happened that did not happen. Pennsylvania will not allow advertising that is "intentionally deceptive." Our stating that this complies with Pennsylvania law is evidence that we are making sure that we send out a flyer that is easy to read. Every aspect of this giveaway, and this is exactly what it is, a giveaway, is clearly spelled out on the flyer. There is no "trickery." We have had over 500 people in to collect prizes. Over 99% have been satisfied with the FREE prizes they have won. I have the flyer in front of me. It clearly states the odds of each prize. This is in the same area on the flyer where all the prizes are listed, and on the front page of the flyer, right above your name. I will leave this with a question that you will refuse so answer: Were you forced to do ANYTHING while you were here? This is a yes or no question.

If you are unhappy with my review I suggest that you use honest business practices and ensure your employees are not asking for people's names and SSN when they present a wining flyer. A quick Google search of car dealership "promotional flyers" of this type will show that I'm not the only one unhappy with this type of dishonesty.
