We understand that you recently purchased a 2011 Hyundai Sonata from Lone Star Auctioneers, Inc. Unfortunately for you, that vehicle was owned by Bob Stallings Hyundai (“BSH”) at the time you purchased it. BSH had accepted the vehicle as a trade-in from a purchaser and subsequently attempted to sell the car to another individual. That individual’s financing fell through and he failed to return the vehicle despite BSH’s numerous demands to do so. Apparently the vehicle was, at some point, towed by Texas Impound Service, LLC, which then engaged Lone Star Auctioneers to sell the vehicle. The Texas Department of Motor Vehicles has very specific rules for the foreclosure of motor vehicles as a result of a storage lien. These rules require the party that has possession of the vehicle to make attempts to contact the rightful owner and law enforcement and to document that party’s efforts. In this instance, we simply do not know whether the proper procedures were followed. Neither Texas Impound Service nor Lone Star Auctioneers has provided BSH with any proof that the proper procedures were followed with respect to this vehicle. We are in the process of attempting to secure this information from Texas Impound Service and Lone Star Auctioneers. This process will take additional time and we are aware that the inconvenience to you, an innocent purchaser, continues. We apologize to you for this inconvenience. Obviously both you and BSH have been harmed in this situation. We recognize that this matter has put you in a very difficult situation, and BSH would like to try to help you. Although under no obligation to do so, we would like to reimburse you the cost of your rental car up to $30 per day until we can sort this matter out. You may send me a copy of your rental car agreement indicating the charges through your date of mailing, and we will promptly send you a check for up to $30 per day. We will also reimburse you later for such charges from your date of mailing until this matter is resolved. In the meantime, we will let you know what we learn from Texas Impound Service and Lone Star Auctioneers. Very truly yours, Marcus Williams, General Manager
