As a dealership our goal is to provide professional and friendly service to all of our customers at all times. When a dispute arises we do all possible to find a resolution that is equitable for all concerned, as long as it is legal and ethical. Unfortunately this situation did not meet either criteria. This person attempted to complete a straw sale which is against our company policy and is illegal in many jurisdictions. He also attempted to have a refund sent to him to which he was not entitled. By way of background, this sale was to be an out of state sale to the state of New York. The car was a used M5. He gave us a $2,500 deposit for the vehicle. He was working with a credit union of his choice for a car loan however he was unable to obtain the financing that met his terms. He then advised us that his mother would purchase the car. She applied for and received a loan from Bank of America. We received a check in the amount of $38,000 from Bank of America for the vehicle. As a dealership we are required by law to deliver vehicles in the state where they will be registered. In this case the State of New York. New York requires the person to whom the car will be registered to be present at the time of registration. We advised this customer of this requirement. He then told us that would be impossible as his mother is in China and would not be available. We told him that if this is the case we would not be able to proceed with the sale. We would be happy to sell the vehicle to him however we must follow all laws regarding the sale, taxation and registration of vehicles. We advised him that we would process a refund for the $2,500 to him and we would return the $38,000 payment to the issuing bank. He wanted us to refund the $38,000 to him. We explained that he had no standing or claim to these funds. We would return the $38,000 to the bank. This amount was refunded to the Bank of America and a check for $2,500 was issued to him. Both refunds were completed. He was attempting to do something that is at least unethical and possibly illegal, which we refused to do. In addition his claims of not getting a refund are false. His deposit was refunded. He did not receive the refund of the bank loan because he was not entitled to it. The refund was however made to the bank.
