I recently purchased a 2018 BMW from this location last month and want to share my experience, which has been a rollercoaster. (391-3-20-.18 Sale of Vehicles. Amended.) - 681­9­.02 Responsibilities of a Used Motor Vehicle Dealer O.C.G.A. 12-9-54 specifically makes such conduct a crime. O.C.G.A. 10-1-390 makes it an unfair business practice to commit a crime in the sale to consumer goods such as a car much like it is unfair to roll back an odometer. So the Georgia consumer may have a civil claim against the seller of a car which will not pass emissions. —— The salesperson, JACKSON ELLIOT, sold me a car knowing that it wouldn’t pass emissions. This liar also secretly added extras to my contract that I explicitly stated I didn’t want included. At first he tried saying that he didn’t add the extra things (which were worth $500). Then I showed him my contract, and he tried saying that adding it helped make the car cheaper overall & that it was still a good deal. Then he tried saying that I really wasn’t paying for it and that the bank paid for it for me…. When I told him that the conversation we had prior to the sale was audio recorded & that I could prove that I never said I wanted those charges, so they never should’ve been added, he got pissed off & insanely rude. He talked about how it was illegal to secretly audio record the conversation, and how I could be faced with, in his words, legal action of fines of up to “$10,000, that’s a lot of money!” & “jail time of up to 5 years!” if he decided to pursue it (the quotes are his exact words). He bragged with an arrogant smirk on his face and his arms crossed, about how I messed up and was in deep trouble for audio recording the conversation without his consent, and explicitly stated “the lawyer doesn’t know what he’s talking about, trust me” while letting out a slight, cocky laugh. Little did Jackson Elliot know, Georgia is a One-Party Consent state :) ! Georgia wiretapping laws are regulated under O.C.G.A. § 16-11-62, § 16-11-64, and § 16-11-66. The law divides wiretapping into two categories, recording conversations (audio) and recording actions (photos and videos). An audio conversation cannot be secretly recorded by a THIRD PARTY (someone not involved in the conversation) in a private place (which he stated the dealership was), however, ANY member of the conversation can indeed covertly record the conversation without the consent of others in a private place! (See above laws). He tried to use the “video recording actions” portion of the law & tried misconstruing it to invoke fear in me, but it was to no avail. Jackson Elliot continued his irate rant essentially going on about how “screwed” I was for “breaking the law”, how “he’s dealt with people like me before” and how “men who get lawyers involved don’t know how to handle things themselves”, and even asked his manager/boss to kick us out of the dealership! This drew the attention of other customers in the dealership as well. A different employee later came and handled the situation in a better manner than I believe Jackson will ever have the capability to do, but the damage had already been done in my mind. Jackson Elliot, lightly putting it, behaved extremely, extremely unprofessionally. Because of his actions and behavior, I will forever tell people to avoid ALM Kennesaw at all costs while he’s there. Beware of dealing with these people . Monday the truck is not ready and Tuesday I get the call its more than the bulb its a module and they have to send the truck off which could take 1-2 weeks after some discussions back and forth they are going to take the part of a truck on the lot and program it then deliver the truck to me. Weds goes by Thurs they call with the bad news truck still has to go to Chevy and it will be 1-2 weeks before I see it. This is a truck I was paying 53,000 for that was unacceptable to me so I cancelled the sale. They still held 3000 of a down payment which was put on a card and that was supposed to be refunded the following Monday according to Gary 08/02/21. The refund didnt take place till 08/04 on a Weds that's the receipt they sent me with the name spelled incorrectly. As of 08-10 nothing has appeared back on the card and after checking with the credit card company there was no pending refund and they also let me know that had it actually been refunded the name would of been spelled correctly the receipt they gave me was a forgery. Thankfully the credit card company will take care of it. Beware these people are not truthful do not take your business here they will cheat and steal from you More

Bait and switch....ALM sent out an email last week for with the “Sell or trade your ride event.” The email stated they’d give up to 130% for your vehicle whether you’re trading it in or selling it to the with the “Sell or trade your ride event.” The email stated they’d give up to 130% for your vehicle whether you’re trading it in or selling it to them. I decided to check it out and found that they weren’t even close to the 130%. It was the same as if there wasn’t a promotion. I went in to get an idea where they’d be number wise. They asked me what my pay off was. What does the pay off amount have to do with how much you’ll give for a vehicle? Nothing......but it does keep them from giving YOU too much. Only one person can win in their eyes and that’s ALM. The sales people I’ve dealt with have always been great, but I quickly learned today that management is crooked. Smooth idea from marketing to get people in the door, but it’s an even better opportunity for buyers to learn about their deceit. They lost me on this dealing. Don’t take the bait. More
