Before any signed purchase agreement was in place, Finance Manager Mike Rodriguez ran my credit. That credit application bears my signature. Under the Uniform Commercial Code, a signed credit application is a negotiable instrument — it is my security. They pulled it, placed a hard inquiry on my consumer report, and now without completing a deal. That is textbook unjust enrichment. They received something of value from me — my credit — and gave me nothing in return. MY CREDIT IS PERFECT WITH TWO MORTGAGES AND THEY SAID THE BANK WANTED $200K TO DO A DEAL! On top of that, I was presented with stacked fees — a documentation fee, a dealer fee, and an electronic filing fee — with no written itemization explaining what each fee covers, which ones are government-mandated, and which ones are pure dealer profit. Under Florida Statute 501.976 and the Florida Deceptive and Unfair Trade Practices Act, dealers are required to disclose exactly that. They did not. More
