If you just purchased a brand-new vehicle, it should be in perfect working condition—not sitting in service for over 30 days due to a part shortage. From a customer rights perspective, the dealership and manufacturer (General Motors) are responsible for ensuring the car meets quality and reliability standards. It’s not your problem that GM doesn’t have the part—you didn’t buy a back-ordered vehicle; you bought a fully functional one. Here’s why their response is not acceptable: 1. Lemon Law Protections – In Florida, if a new car has been in service for over 30 days for repairs (whether consecutive or not), it may qualify as a lemon, giving you the right to demand a refund or replacement. 2. Unfair Burden on the Customer – They’re asking you to simply wait indefinitely for a part, which isn’t reasonable. You bought a car to drive it, not store it at the dealership while they figure out logistics. 3. Failure to Deliver a Working Product – A brand-new car should not require major repairs immediately. If it does, that’s their issue to resolve quickly—not yours to suffer through. 4. Lack of a Timeline – Their response doesn’t provide any definitive date for the part’s arrival. That could mean weeks or months without your vehicle, which is completely unacceptable. What You Can Do Next: 1. Demand a Buyback or Replacement – If the car has been undrivable for 30+ days, you may be legally entitled to a refund or replacement under Florida’s Lemon Law (especially if the issue affects safety, drivability, or major components). 2. Escalate to GM Corporate – The dealership is blaming General Motors. Call GM’s corporate customer service and file a complaint about the situation (1-800-222-1020 for Cadillac). 3. Consider Legal Action – If they refuse to resolve this, a Lemon Law attorney can put serious pressure on them. In many cases, GM will settle quickly rather than go to court. 4. Push Public Pressure – If they won’t act, keep the pressure on by posting reviews, filing a BBB complaint, and engaging on social media. Dealerships hate bad PR. Bottom Line: They sold you a defective vehicle and expect you to just wait. That’s not your problem—it’s theirs to fix immediately. I’d push for a refund or replacement ASAP.
