SUMMARY OF COMPLAINT Riverside Autoplex advertises specific used vehicles for sale through their website and social media platforms. However, upon arrival at the dealership, consumers are told these advertised vehicles are “unavailable” and are instead pressured toward significantly more expensive new vehicles. This represents classic bait-and-switch tactics and constitutes deceptive trade practices under state and federal consumer protection laws. DECEPTIVE PRACTICES IDENTIFIED 1. FALSE ADVERTISING Riverside Autoplex prominently displays vehicles on their website and social media as available for purchase when they have no intention of selling these vehicles to retail customers. This constitutes false advertising under Oklahoma Consumer Protection Act (15 O.S. § 751 et seq.). 2. BAIT-AND-SWITCH TACTICS The dealership uses advertised vehicles to lure consumers to the location, then claims these vehicles are unavailable and attempts to redirect customers to more expensive vehicles with higher profit margins. This is a textbook bait-and-switch scheme prohibited under federal FTC regulations (16 CFR Part 238) and state consumer protection laws. OKLAHOMA STATE LAWS Oklahoma Consumer Protection Act (OCPA) (15 O.S. § 751 et seq.) Specific Violations: 15 O.S. § 753(8) - “Advertises, knowingly or with reason to know, the subject of a consumer transaction with intent not to sell it as advertised” Riverside Autoplex advertised the Nissan Xterra and approximately 20 other vehicles with no intention of selling them as advertised 15 O.S. § 753(9) - “Advertises, knowingly or with reason to know, the subject of a consumer transaction with intent not to supply reasonably expected public demand, unless the advertisement discloses a limitation of quantity” The dealership created artificial scarcity through “limited vouchers” while simultaneously advertising vehicles they had no intention of selling 15 O.S. § 753(5) - “Makes a false representation, knowingly or with reason to know, as to the characteristics, ingredients, uses, benefits, alterations, or quantities of the subject of a consumer transaction” The dealership misrepresented the availability and sale status of advertised vehicles 15 O.S. § 753(20) - “Commits an unfair or deceptive trade practice as defined in Section 752 of this title” The systematic bait-and-switch scheme constitutes both unfair and deceptive trade practices 15 O.S. § 752(13) - Defines “Deceptive act or practice” as “a misrepresentation, omission or other practice that has deceived or could reasonably be expected to deceive or mislead a person to the detriment of that person” Advertising unavailable vehicles is a clear misrepresentation that deceives consumers 15 O.S. § 761.1 - Consumer Remedies and Unconscionable Practices Subsection (B)(1): The dealership “knowingly or with reason to know, took advantage of a consumer reasonably unable to protect his or her interests” by targeting consumers with credit challenges Civil penalties of up to $2,000 per violation for unconscionable acts Potential criminal penalties: misdemeanor for first offense (up to $1,000 fine and/or one year imprisonment); felony for violations involving $500+ or second offense (up to $5,000 fine and/or 10 years imprisonment) Oklahoma Used Motor Vehicle, Dismantler, and Manufactured Housing Commission Regulations (Title 765, Oklahoma Administrative Code) OAC 765:16-3-1 - General Prohibition: “Any other advertising or advertising practices found by the Commission to be false or misleading shall be deemed violations of the law” OAC 765:16-3-2 - “All advertised statements shall be accurate, clear and conspicuous” More

Randy Anderson, Jacob Brown, and the finance department at Riverside Autoplex refuse to take or return my phone calls. On Nov 15 2024 we traded 2 vehicles for 2 new vehicles. That part was seamless and at Riverside Autoplex refuse to take or return my phone calls. On Nov 15 2024 we traded 2 vehicles for 2 new vehicles. That part was seamless and professional. Now Dec 30 2024 we are being called by finance companies wanting money for vehicles we haven't owned in nearly 45 days. Riverside fails to pay off trade in causing our credit to take a hit on non-payment. We have had to resort to filing a verbal and written complaint to Ford Consumer Affairs and the Better Business Bureau of Tulsa in regards to Ford Riverside Autoplex of Poteau Oklahoma. bought a truck back in July. 2 weeks later I started having issues with it. transmission lead frame was bad on it. it has a bad oil leak. the rack and pinion is bad on it. they 2 weeks later I started having issues with it. transmission lead frame was bad on it. it has a bad oil leak. the rack and pinion is bad on it. they was rude when I got there, becasue they assumed i couldnt afford anything they was kissing my butt when they figured out i could. the mechanic there is among the rudest people I ever met in my life yet again assumed I couldn't afford it. it was an experience that was bad. getting a truck that has so many issues, it's literally costing everything I have to fix it. all because they didn't do their jobs when the truck came in and actually repaired everything. they lemoned me hard. that place needs to be shut down.
