Hello d_coop1996, unfortunately circumstances such as this are out of the dealers hands. There is a very serious inventory shortage in our nation and this also applies to current units that need parts as well. The reason for the deposit is for us to be able to take it off the market. It shows a commitment from the buyer. From what I have gathered my sales associate was very thorough on the circumstance we were in. It needed a part to be fixed; that part was on backorder with an unknown delivery date. Knowing that you still paid a deposit and signed a form stating you knew it was a non-refundable partial payment. I sincerely apologize for the time it has taken, this is not ideal for any of us.

Jim Doran’s lack of inventory is not my problem. I put a deposit on a vehicle that I was promised a couple of days after the 13th of May. It was not disclosed to me that the part was back ordered. They took my deposit based on a date that was given to me by their salesman. They expected me to sign bank papers committing to a loan in which I would be responsible for making a payment for a vehicle I would not have possession of. This is ridiculous, NO ONE would commit to purchasing a vehicle this way. You lied about the date it would be available when you had no idea when the parts would be there. No one would commit to this deal!!!!

I was given a date of when the truck would be finished regardless of what your salesman said. Nobody in their right mind would purchase a vehicle when they have NO idea of when they would receive it. That doesn’t even make sense. Read your reply, does that make sense to you?

You have got to be kidding me, I am not an idiot. Who purchases something with no clue of when it will be received? This is absolutely ridiculous!! Use common sense here, who would do that. Your salesman is trying to protect himself. He lied and he knows it. If you were told to sign loan papers to make you responsible for making payments on something you have no idea when you might receive, would YOU buy it? WHO would?

I have filed a fraud report with my bank and am seeking legal council now. I would rather pay an attorney $2000 than pay you $500. This is about ethics and principles. This is no longer about the money. I’m not gonna stand by and let you do this to other people.

Mr. Cooper, you didn't sign loan papers, you agreed to a partial payment that was very clearly stated that it was a "non-refundable" partial payment. I have the document as well as a screen shot of the text message you sent saying you agreed to it. If you would like I can email these to you. I can tell you are frustrated; let me look further into the arrangement and let me talk to the owner of the store. I am the marketing director as well as the CX Agent (Customer Experience). I totally understand things don't always happen the way we want them to and if there is an opportunity for me to help I am going to try the best I can. No guarantees, but allow me to look further into this.

d_coop1996 responded

I agreed to the partial payment based on the truck being finished a couple days after the transmission was there. I was told that date was the 13th. I’m not lying, this is the truth. If I had known that was not the date I wouldn’t have agreed. NO ONE would have agreed to that. I appreciate whatever you can do.

d_coop1996 responded

Your salesperson is not telling you the whole truth, our conversation was mostly over the phone not text. I too have saved it. Think about it would you agree to a deal like that. I didn’t sign the loan papers because of what the service and parts departments told me. Kobe NEVER told me about the back order, the parts department did. After I gave you my deposit. This isn’t fair.

I’ll assume you have decided not to refund my deposit?
