Mr. Collier, John Fee, General Manager at Koons Kia called you after Kim Burke advised him that you where upset because the car had not been paid in full. At which time, Mr. Fee, said he understood about you being a little upset, he told you he was going on vacation for a week and would call you when he returned. While he ws gone, you made a complaint to Kia Motors, which they closed the file, stating that they could not work out price differences on vehicle purchases. That is when Amy Collins, my Customer relations Manager emailed you about this matter. You then returned an email starting that you would rather settle this matter thru an attorney. Our attorney contacted you ragarding this matter and you where going to make a settlement, spliting the cost on what you owed, and the attorney was going to waive any attorney fees to make this go away. That is all Mr. Fee wanted from the start of all of this, but you wanted to take it to this level. You then emailed the attorney back and stated you only had about 239.00 hidden in account that your wife did not know about because you didn't want her to be mad at you because you knew you owed the monety to Koons. You then emailed again to the attorney starting you would see us in court.

I did think about settling, but it just was not the right thing to do. The contract is not logical, having a down payment in a deal were we wanted to pay off the car in full. Why didn't they just move that $1000 to the bottom line with the rest of cost. It would have made it clear as a bell, if they wanted to add $1000 to the deal. Since that $1000 was added with the credits I see it as a discount. When they asked us to write the check for $21,024.86 we did just that. The Kia people who set up the contract saw it as a discount too. When we asked them what amount to write on the check, it was the same price that James the salesman asked if we would be willing to pay. That price was $21,024.86. We paid it off with a check that was cashed 2 days later. Two weeks later Koons Kia called saying they turned our discount into a down payment and that we owe Kia $1000. They still had not paid the taxes and title on the car and tried to use that as leverage the make us pay. I have the voicemail and emails to back this up. A month has gone by, and they never paid the taxes or sent in the title for the car. The Kia collections lawyer called me and offered me a deal, if I paid $500 the whole thing would go away. I made an offer for less but later that night decided I would rather see them in court. As it turns out they ended up sending us a FedEx package with the paper work for the taxes and title so that we will have to pay them. The letter that came with it from John Fee the General Manager of Koons Kia starts like this: “YOUR VEHICLE IS NOT REGISTERED; YOU MAY NOT LEGALLY DRIVE YOUR VEHICLE”. In other words they never planned to register the car which should have been done the first week after the sale. If this is not criminal it should be. We are hard working people, I have worked for the same company for over 30 years. We pay our bills and we pay our taxes. But we hate to be cheated so we have no choice but to go to court and come the sites like this one and make sure people have a choice. Our choice was stolen. If they had put the price that they wanted for the car on the bottom line we could have had the choice to pay the extra money they wanted or shop somewhere else. The price they told us to write the check for was $21,024.86 this included $4000 in discounts and the trade-in.
