Update (March 12, 2026): As of March 12, 2026, it has been 65 days since our full cash payment cleared the bank, and we still have not received the vehicle title, registration, or license plates. We sen been 65 days since our full cash payment cleared the bank, and we still have not received the vehicle title, registration, or license plates. We sent 12 written requests asking for documentation and clarification regarding the transaction. The dealership responded only once, stating that it is “company policy” to run credit applications and prepare a backup finance contract even for cash purchases in case a personal check bounces. Despite the public responses posted here, our direct written requests to the dealership have largely gone unanswered. Our credit reports show 14 inquiries combined between both purchasers connected to the January 4 transaction. Experian has already removed six of those inquiries (three per purchaser) after our dispute. In addition, a lender involved in the transaction has confirmed in writing that a credit inquiry associated with this transaction was submitted for removal following their investigation. We were never informed that a credit application or credit inquiries would be submitted for a cash purchase, and we were never provided with any credit application or credit authorization documents related to these inquiries. In a written email dated February 9, 2026, the dealership’s General Sales Manager stated that a credit check and backup finance contract were prepared as part of the dealership’s company policy in case a personal check bounces. For transparency, we would appreciate clarification regarding when the title transfer for this vehicle was submitted to the California DMV and what authorization was relied upon to obtain our credit reports. We remain willing to resolve this matter transparently and in writing. Original Experience (Jan 4, 2026): Our experience with Capitol Nissan in San Jose involved a full cash purchase on January 4, 2026. We purchased a 2021 BMW as a full cash transaction for $40,500.80 paid by personal check and declined financing multiple times. The signing process began shortly before closing time and continued after the dealership had closed. The following day at approximately 4:18 PM, we received documents by email showing a financed transaction with a higher total price and a lien. Nearly all of the documents lacked dealer signatures (only one contained a dealer signature). A finance company later confirmed that a credit application had been submitted, although no loan account was opened. We continue to request written clarification regarding the credit inquiries and the status of the title transfer. More
